Industry Odisha Bureau, Sept 18: The Food Safety and Standards Authority of India (FSSAI) has initiated proceedings against Nestlé India over alleged non-compliance involving three infant nutrition products.
The cases concern NAN Excella Pro Stage 1, Lactogen Pro 1 and a follow up formula manufactured by Nestlé India. FSSAI examined the products and promotional material available on e-commerce platforms.
For NAN Excella Pro Stage 1, the authority flagged promotional claims referring to “5HMOs” and “Whey Protein”.” FSSAI sought clarification from the company. It stated that the product violated Regulation 4(2) of the Food Safety and Standards (Food for Infant Nutrition) Regulations, 2020.
Promotional material for Lactogen Pro 1 was also examined. FSSAI flagged a claim describing whey protein as easy to digest and stated that the product was violating the same regulation.
The third case involves a follow up formula. According to the notice, a sample was found to be sub-standard for biotin content during laboratory testing. A re-analysis by a Referral laboratory also found that the sample did not meet the prescribed biotin requirement under the 2020 regulations.
The notice states that three separate cases have been filed against Nestlé India. Two concern promotional claims, while the third related to the laboratory finding.
It is noteworthy to mention that the proceedings do not mean the products have been banned or that all batches are unsafe/ The final outcome will depend on the finding of the competent authority. FSSAI’s regulations place specific restrictions on promotional material for infant food.
